1. Acceptance of Terms

By accessing or using Capture Trace ("the Service"), operated at capturetrace.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Capture Trace is a screen recording and sharing platform that allows users to:

  • Record their screen, webcam, and audio directly in the browser
  • Capture and annotate screenshots
  • Upload video files
  • Share recordings and screenshots via unique links
  • Generate one-time upload links for receiving video content

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Promptly update any changes to your account information
  • Accept responsibility for all activity that occurs under your account

You must verify your email address to activate your account. We reserve the right to suspend or terminate accounts that use false information.

4. User Content

Ownership

You retain ownership of all content you create, upload, or share through the Service, including recordings, screenshots, and videos ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content as necessary to provide the Service.

Responsibility

You are solely responsible for your User Content. You agree that your content will not:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Contain malware, viruses, or harmful code
  • Include unauthorized recordings of private conversations or activities
  • Contain illegal, abusive, threatening, or harassing material
  • Include sexually explicit content involving minors
  • Violate the privacy rights of any third party

Content Removal

We reserve the right to remove any User Content that violates these terms or that we determine, in our sole discretion, is harmful or objectionable. We may also remove content in response to valid legal requests.

5. Sharing and Privacy

When you share a recording or screenshot via a share link, anyone with that link can view the content. You are responsible for managing who has access to your share links.

One-time upload links allow third parties to upload content to your account. You are responsible for the distribution and use of these links. Upload links expire after 24 hours or after a single use, whichever comes first.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools to scrape, crawl, or download content from the Service
  • Impersonate any person or entity
  • Use the Service to distribute spam or unsolicited communications
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Upload excessively large files with the intent to abuse storage resources

7. Intellectual Property

The Service, including its design, logos, code, and documentation, is owned by Capture Trace and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

8. Service Availability

We strive to maintain the Service's availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any downtime or data loss.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTURE TRACE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF YOUR USE OF THE SERVICE.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify and hold harmless Capture Trace and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the Service.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved in the appropriate courts of jurisdiction.
